Inside A&F
Official Rules of Participation (“Official Rules”)

Welcome to Inside A&F. Inside A&F is managed by Abercrombie & Fitch (“A&F,” “we,” or “our”) on an online platform operated by our third-party partner, Fuel Cycle, Inc. These Official Rules are intended to describe the rules for participation in Inside A&F.

Eligibility
Inside A&F is currently only available to United States residents age eighteen (18) and older, or to United Kingdom residents age eighteen (18) or older. Employees, officers, directors, agents, and representatives of Abercrombie & Fitch (“A&F”), which includes Hollister Co. (“HCO”), are not eligible to join. Limit one (1) Inside A&F Community Membership Account (“Account”) per person, per email address.

Benefits
Inside A&F Community Members (“Members” or “You”) are able to get a behind the scenes glimpse at A&F and have access to exclusive sneak peeks and polls. Members will also be able to earn Inside A&F points by completing activities as specified by A&F. A&F shall offer Members approximately one (1) activity to complete each month. Activities and the corresponding Inside A&F point value shall be determined at  A&F’s sole discretion.

myABERCROMBIE Points
Once Members have earned 1,250 Inside A&F points,  Members will be able to convert those Inside A&F points into myABERCROMBIE points. Each Inside A&F point is equal to one (1) myABERCROMBIE point. To convert and redeem your Inside A&F points, select the applicable myABERCROMBIE reward option icon on the Points Overview page. Points converted and redeemed to your myABERCROMBIE account are manually processed on the 15th and the last day of the month in which You accept the points. Members can expect to see their points in their myABERCROMBIE account in 30 days. For more information about redeeming points, please click here

You will still be able to earn Inside A&F points even if You are not a myABERCROMBIE member. However, You will not be able to transfer those points to a myABERCROMBIE account or redeem your points for any myABERCROMBIE benefits unless and until you create a myABERCROMBIE account. Creating a myABERCROMBIE account is free.

If You have any questions regarding how to earn Inside A&F points or convert them into myABERCROMBIE points, please contact your Inside A&F Community Moderator.

Email Communication
After You sign up to participate in Inside A&F, we will contact You via email at the email address used to create your Account. Inside A&F emails will include an opt-out link, should You no longer want to receive these types of emails. You may opt-out at any time.

Cancellation of Inside A&F Account
We don’t think anyone will want to stop getting the great benefits of the Inside A&F community, but Members who decide they want to cancel their Account can do so by clicking on the “Close My Account” link on the Account Settings page of the Account.

Please note, if You cancel your Account before converting your Inside A&F points into myABERCROMBIE points, You will forfeit those points. myABERCROMBIE points that have already been converted or are already being transferred to your myABERCROMBIE account will not be forfeited.

Non-Disclosure & Confidentiality
During your involvement in Inside A&F, it is very important that You protect any and all Confidential Information (described below) to which You have access or knowledge. This means that You should not disclose or discuss any of the information or products that You see or hear about in Inside A&F with anyone else besides those who are present in Inside A&F with You, including  your friends and acquaintances. Also, You must not post any Confidential Information on social networks, blogs or on any sort of webpage on the internet. This applies even after your participation in Inside A&F ends.

The Confidential Information that You must protect includes, but is not limited to: information or material which relates to A&F's designs, concepts, specifications, procedures or processes, product lines, packaging, manufacturing, marketing, trademarks, copy rights, patents, trade secrets, customer information, including personal information or customer lists, vendor or merchant lists, pricing information, licenses, software, technology, internal company policies, financial information, merchandising, advertising, distribution, sales plans or other business plans and operations, retail store operations, associate information and any information of the type described above which A&F treats as proprietary or designates as confidential, whether or not owned or developed by A&F. Confidential information also includes the fact that the merchandise is part of the Inside A&F community. 

Any opinions that You share with Inside A&F may be used by A&F for any reasonable business purpose, determined in A&F’s sole discretion, including without limitation, in connection with the marketing, advertising and promotion of the A&F brands (e.g., customer testimonial online).



General Terms
 
All questions regarding Inside A&F in general or these Official Rules should be directed to your Inside A&F Community Moderator.

Your participation in Inside A&F is subject to your acknowledgement and acceptance of these Official Rules, Fuel Cycle, Inc.’s Privacy Policy, and Abercrombie & Fitch’s Privacy Policy. You agree that A&F may use your personal data to conduct market research or to contact You about issues related to your participation in Inside A&F. You understand that You may withdraw consent for A&F’s use of your data at any time by contacting the Inside A&F Community Moderator or by emailing privacy@anfcorp.com. A&F reserves the right to suspend or cancel any Membership and participation in Inside A&F at any time for any reason, including for any suspected fraudulent use of Inside A&F.
A&F is a private label brand. To protect its intellectual property rights, any suspected resale of our merchandise for personal or business profit is strictly prohibited. Those suspected of reselling are prohibited from becoming a Member. A&F will not accept any order found to have characteristics of reselling. A&F reserves the right to cancel all subsequent orders from such customers.
As to the requirement of only one (1) Inside A&F Membership Account per person per email account, if there is a dispute regarding the email account, it will be deemed to be the natural person who is assigned to the submitted email address by an internet provider, or online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
These Official Rules supersede all previously published Official Rules in their entirety.
A&F reserves the right to make activities, bonus points, or other promotional offers available to select Members based on geographic location, Inside A&F participation, and/or information supplied by the Member, or other factors. A&F reserves the right to add, withdraw, amend, or otherwise change bonus opportunities at any time and at its sole discretion, with or without notice to Members.
A&F reserves the right to cancel Inside A&F and/or its benefits at any time with or without notice to Members. Inside A&F points that have not been converted to myABERCROMBIE points or transferred to your myABERCROMBIE account shall be forfeited if Inside A&F is terminated or if You close your Inside A&F Community Membership.
A&F reserves the right to change these Official Rules with or without notice, including the terms related to the available activities and earning points.
All title and intellectual property rights in and to any content that is accessed, viewed, streamed, or downloaded from the Inside A&F site (including music, photos and videos) remains the sole and exclusive property of A&F or its licensor and use of such content is subject to the restrictions imposed by these Official Rules and Fuel Cycle’s Terms of Service, as well as applicable copyright and other intellectual property laws and treaties. Content may not be used in a manner that exceeds the specific rights granted and individuals are strictly prohibited from copying, modifying, selling, re-licensing or distributing content. Members agree that they will not interfere with A&F’s or its licensors’ rights to their content and will not circumvent, or attempt to circumvent, any technology or methods used by A&F or its licensors to prevent the unauthorized reproduction or distribution of content accessible via Inside A&F.
By agreeing to participate in Inside A&F, Members release A&F, its parent and subsidiaries and affiliate entities, and their respective, directors, officers, employees and agents (the “Released Parties”) from all liability with respect to Inside A&F (including all myABERCROMBIE points), the misdirection or misuse of points or any myABERCROMBIE points, or the use of any myABERCROMBIE points by an individual other than myABERCROMBIE Member to whom the myABERCROMBIE points were transferred. By participating in Inside A&F, Members hereby release the Released Parties from and against any and all claims, damages, losses, liabilities, and other expenses (including, without limitation, attorney’s fees) relating to participation in Inside A&F, use of Inside A&F, or agreement to these Official Rules.
The Released Parties make no warranty, express or implied, including, but not limited to, any warranties of merchantability or fitness for a particular purpose with respect to Inside A&F, Membership in Inside A&F, or any products or services related to Inside A&F.
Members are responsible for providing the correct myABERCROMBIE account information to receive transferred myABERCROMBIE points and to update their Inside A&F Membership should their account information change.
Inside A&F is void where prohibited by law. These Official Rules will be governed by and construed under the substantive laws of the State of Ohio, without reference to conflict-of-laws considerations.
By becoming a Member of Inside A&F, You agree to be bound by these Official Rules.
ANY DISPUTE THAT CANNOT FIRST BE RESOLVED THROUGH INFORMAL METHODS WILL BE SUBMITTED TO BINDING ARBITRATION UNDER THE COMMERCIAL ARBITRATION RULES OF THE AMERICAN ARBITRATION ASSOCIATION (AAA) then in effect (the “Rules”), except as modified herein. The arbitration will be administered by the AAA. Claims or disputes that fall within the scope of the small claims court’s limited jurisdiction may, however, be submitted to such court. BY AGREEING TO ARBITRATE, EACH PARTY IS GIVING UP ITS RIGHT TO GO TO COURT AND HAVE ANY DISPUTE HEARD BY A JUDGE OR JURY. If an in-person arbitration hearing is required, then it will be conducted at a location which is reasonably convenient to both parties with due consideration of their ability to travel and other pertinent circumstances. If the parties are unable to agree on a location, the determination should be made by an independent arbitrator. The Member and A&F will pay the administrative and arbitrator’s fees and other costs in accordance with the applicable arbitration rules; but if the applicable arbitration rules or laws require A&F to pay a greater portion or all of such fees and costs in order for this arbitration provision to be enforceable, then A&F will have the right to elect to pay the fees and costs and proceed to arbitration. The arbitrator will apply and be bound by these Terms, and will determine any dispute according to applicable law and facts based upon the record and no other basis. After the hearing, the arbitrator(s) will decide the dispute and render a written decision setting forth the issues adjudicated, the resolution thereof and the reasons for the award. Any decision rendered in such arbitration proceedings will be final and binding on the parties, and judgment may be entered thereon in any court of competent jurisdiction. The Federal Arbitration Act (“FAA”), will apply to the dispute and will govern whether the dispute is subject to arbitration, including the No Class Action Matters section below. A Member can obtain AAA procedures, rules and fee information as follows: AAA: 800.778.7879, http://www.ADR.org. This section survives the termination of the Membership and/or Inside A&F.
No Class Action Matters: Disputes hereunder will be arbitrated only on an individual basis and will not be joined or consolidated with any other arbitration or other proceedings that involve any claim or controversy of any other party. THIS MEANS MEMBER AND A&F AGREE THAT EACH MAY BRING CLAIMS REGARDING SUCH DISPUTES AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING OR AS AN ASSOCIATION. There will be no right or authority for any dispute to be arbitrated on a class-action basis or on any basis involving disputes brought in a purported representative capacity on behalf of the general public, or other persons or entities similarly situated. But if, for any reason, any court with competent jurisdiction holds that this restriction regarding arbitration on a class-action basis is unconscionable or unenforceable, then the dispute must be brought exclusively in a State or Federal court located in Columbus, Ohio as set forth above. Notwithstanding any other provision of these Terms, any and all issues relating to the scope, interpretation and enforceability of the class action waiver provisions contained herein (described in this “No Class Action Matters” section), are to be decided only by a Federal or state court located in Columbus, Ohio, and not by the arbitrator. The arbitrator does not have the power to vary these class action waiver provisions. This section survives the termination of the Membership and/or Inside A&F.
Limited Time to File Claims: To the fullest extent permitted by applicable law, if Member or A&F want to assert a dispute against the other, then Member or A&F must commence it within one (1) year after the dispute arises, or it will be forever barred. Commencing means filing for arbitration with the AAA as set forth in Binding Arbitration of this Dispute Resolution section, or filing an action in State or Federal court as specified above.
